1. Scope
These general terms and conditions govern the relationship between Omnilex AG, Hohlstrasse 186, 8004 Zurich (hereinafter Solvian) and the user for the services offered via solvian.ch.
These terms govern the Solvian service. They are meant to make clear what we promise and what you can rely on.
This English version is a translation for your convenience. Only the German version (AGB) is legally binding.
Version of 7 October 2026.
These general terms and conditions govern the relationship between Omnilex AG, Hohlstrasse 186, 8004 Zurich (hereinafter Solvian) and the user for the services offered via solvian.ch.
With the Basic, Family and Assets packages, Solvian supports spouses with an amicable divorce in Switzerland under Swiss Civil Code Art. 111 ff. The service comprises the digital intake of the situation, a first draft agreement as a basis for discussion, and legal guidance until the final decree by a legal expert in family law who cooperates with Solvian.
With the Assist package, Solvian guides one spouse in a divorce that is not amicable, in particular a divorce on petition by one spouse (Swiss Civil Code Art. 114 f.) or a joint petition with partial agreement (Art. 112). The service comprises a legal assessment of the position and the options, preparation for negotiations or mediation, and preparation of court submissions and hearings. In this case Solvian advises only the user and not their spouse.
Solvian itself does not provide representation in court. Where representation in court is required, we refer you to independent specialists; their work takes place under a separate engagement with the spouses or the person concerned.
The free first consultation does not yet establish a paid engagement. A contractual relationship only arises when the user pays for the agreed service package.
For the Basic, Family and Assets packages, the user confirms by paying that their spouse fully agrees to engaging Solvian jointly. How the costs are shared is a matter for the user.
For the Assist package, only the user is a party to the contract. The spouse's consent is not required.
Remuneration is a fixed flat fee until the final divorce decree. For the Assist package, the flat fee covers the scope of services for guiding one side as described on the pricing page. The flat fees currently in force are shown transparently on the pricing page.
Cantonal court fees and any third-party expenses (for example notary fees where a home is involved) are not part of the flat fee. The range is communicated before filing.
Exceptional additional work beyond the agreed scope of services is only charged after prior written agreement.
Prompt and proper guidance requires both spouses, or for the Assist package the person guided, to provide the necessary documents completely and in good time. These include, in particular, current occupational pension (BVG) statements, tax documents and evidence of assets and debts.
The spouses, or for the Assist package the person guided, may end the engagement at any time. We charge a fair amount for the work already done and discuss it with you beforehand.
Solvian may end an engagement under the Basic, Family or Assets packages in particular if it turns out that the conditions for an amicable divorce are not (or no longer) met. In that case, flat fees already paid are settled pro rata according to the work done. A switch to the Assist package is only possible with a different legal expert from the one who guided both spouses jointly.
Solvian and the guiding legal experts are liable for damage resulting from a breach of contractual obligations in accordance with Swiss law. Liability for slight negligence is excluded to the extent permitted by law.
The draft agreement created by the Solvian system is a basis for discussion and not a finished, court-ready agreement. The agreement only becomes binding after it has been legally reviewed, finalised and approved by the court.
The processing of your data is governed by the privacy policy. The guiding legal experts are additionally subject to contractual and statutory confidentiality obligations under Swiss law.
The contractual relationship is governed exclusively by Swiss law. The exclusive place of jurisdiction is Zurich, subject to mandatory consumer places of jurisdiction.
Solvian may amend these terms. The version in force at the time the contract was concluded applies.
